Cohabitation - Samenwoning contract

Δημοσιεύτηκε σε φόρουμ Βέλγιο

Hello there,
Is there anyone among you that can enlighten me about Cohabitation? For the moment I live in Belgium and with my Belgian partner we will apply for cohabitation. But still the cohabitation procedure will not be finished before my residence permission ends. So between,I wont have an valid identity card for 2 weeks of so. The first rule; they told us, that we have to live in the same address and we do live in the same address but when we have to present our documents and when they see that my identity card is not valid anymore, will it be a problem? if any of u has an experience or safe knowledge, I ll be so glad to be informed.
Thank you

    Hi Lanny,

My answer about unmarried letter was for Ritch. I don't know for sure the procedure for marriage couple, but for you I think it's even easier because you already married, so you don't need to make cohabitation contract anymore. I think the 1st thing that you and your husband need to do is to register himself in Belgium and then he will get Belgium ID for 5 years and after that register yourself in the Belgium and then you will get your Belgium ID for 5 years.

What Mr. Ferry recommended about buitenlandsepartner.nl is correct. Your husband could find out more about the procedure of Belgium route there. http://www.buitenlandsepartner.nl/forum/viewforum.php?f=94

    Good luck.

Yes it is possible, it is called the Belgium-route...or European Route..please go for details to buitenlandse partner..

If you register yourself in a smaller city...you may get your orange card (5 months permit in Belgium) then after 5 months max...they have to issue you the 5 year permit..and with this 5 year permit you and your husband can register yourself in Holland and appy for a 5 years residence permit in Holland...this is the fastest and easiest way to get into Holland...the MVV will be costly and takes more time ...and hassles...the advantage is that you don't have to go to Belgium but can get residence permit in Holland directly...but am sure your husband knows the way already....ck buitenlandse partner..all the questions are answered there...
    regards,

    Ferrie

    success,

    Hi Shanti,

You mentioned about the unmarried letter from my government, my question is what if I already married with my dutch husband and next month I will go to holland on my 90 days tourist visa, is it possible for me to apply for cohabitation? He will rent a house in belgium and we will live there. I'm still a bit confuse about it and I hope you can give me some more information, thanks.

    Hi Ritch,

To apply as partners, you should go to the stadhuis in your city. You tell them that you are going to make samenwoning contract. The papers you need are: ID cards of you and your partners and a letter from your government that stated you are single (not married or having relationship with anyone else other but your current partner). Other requirement is that you and your partner must live in the same address.

After that, they will tell you what to do next until you get new residence permit but it takes time.

    Cheers.

We were married last year and since then I got multiple entry visa for 2 years,I only can stay maximum 90 days in holland and after stay 90 days in my country I can go back there for another 90 days. My husband told me that when I go to holland next month for 3 months, he will rent a house in Belgium and we will stay there, so that I can get my residence permit. Currently he is staying in Holland and work there also, but once I come to Belgium he said that I will be able to register myself there to get my residence permit. Is that possible?

    Hi Lanny,

not sure what you mean, but a tourist is just for that being a tourist..max 90 days..the only way you can turn it into a domicile is if you and your partner stay outside of your partner's country ...so if your partner is Dutch..make sure to register yourself in e.g. Belgium or Germany...after 6 months ..after you have gotten your 5 year FCard..you can apply to get a 5 year Fcard from Holland...
see website BP...buitenlandse partner...it is also in English...
